Right of withdrawal

In accordance with the articles 64 and 67 of Legislative Decree no. 206/2005, the buyer may cancel the contract by giving written notice by recorded delivery with acknowledgement of receipt, which has to be sent to Bersanetti Giovanni Via della Navigazione Interna 15, Zona Industriale, 35129, Padua, Italy.
The right of withdrawal may be exercised within 14 business days after the receipt of the goods.
The integrity of the goods is an essential condition for exercising the right of withdrawal, the goods must arrive at Bersanetti Giovanni Via della Navigazione Interna 15, Zona Industriale, 35129, Padua, Italy. It is the costumer’s responsibility to make sure that goods arrive unaltered to us. The Bersanetti Giovanni company will refund you the price – but not the transportation costs for the return of the goods – within the timeframe stipulated by Legislative Decree no. 206/2005 and after notification, by the purchaser, of the necessary data to enter the sum to your credit.
The notification can be sent within the above-mentioned timeframe also via telegram, telex, e-mail and fax, on condition that it is confirmed by registered letter with acknowledgement of receipt within 48 hours after; the registered letter is intended as sent in time if delivered to the post office within the time provided by applicable law. The applicability of Article 64, 3rd paragraph (refund in lieu of notice) is expressively denied. The exercise of the right of withdrawal implies that at the time of the receipt by the above-mentioned communication company the parties are released from their contract obligations except from additional legal obligations, in the case that the obligations themselves have been in the meantime carried out, completely or in part. If the goods have been delivered, the consumer is obliged to return it according to the procedure and time described also in the section “how to cancel an order”. As for the expiry of the deadline, goods are to be intended as returned when they are delivered to the accepting post office.
